Bluegrass Lending SMS Terms of Service

By submitting your telephone number or otherwise agreeing to receive text messages (“Opting In,” “Opt In,” or “Opt-In”) from Bluegrass Lending, you agree to be bound by these SMS Terms of Service (“Terms”), the Company's Privacy Policy, and any other applicable terms related to your participation in Bluegrass Lending's text messaging service (“Service”). You may receive both transactional (informational) messages related to the offer and marketing messages if you opt in for both. If you do not agree with these Terms, you must immediately cease using the Service and opt out, as described below. We may update or amend these Terms at any time, and such amendments will be effective upon posting of the updated Terms at the link provided next to the checkbox during the opt-in process.

1. Consent for SMS Communication

By opting in, you consent to receive SMS communications from Bluegrass Lending as follows:

Transactional (Informational) Messages: You agree to receive transactional messages related to your claim of an offer, including offer details, redemption instructions, and reminders for the offer you claimed. These messages are necessary for completing the transaction and ensuring you can redeem your offer.

Marketing Messages: If you check the box to receive marketing messages, you agree to receive promotional offers, updates, and other marketing communications from Bluegrass Lending. You can opt-out of marketing messages at any time by replying with "STOP" or following the instructions provided.

2. How to Opt In

When you opt in by submitting your phone number and agreeing to receive messages, you confirm that you are the subscriber or authorized user of the phone number provided. By checking the checkbox next to “Receive special deals via SMS from Bluegrass Lending,” you explicitly consent to receive both transactional and marketing SMS messages.

If you choose to receive marketing messages, you are consenting to receive promotional content, special offers, and updates related to Bluegrass Lending. You will also be given access to the full SMS Terms of Service linked next to the checkbox for marketing opt-ins.

3. How to Opt Out

You may opt out of receiving marketing messages at any time by replying to any message with "STOP," "END," "CANCEL," "UNSUBSCRIBE," or "QUIT."

Once you opt out, you will receive a confirmation message indicating that you will no longer receive marketing-related messages.

Transactional Messages: Even if you opt out of marketing messages, you will continue to receive essential transactional messages regarding any offers you have claimed.

Marketing Messages: Opting out of marketing messages will stop all future marketing communications, but transactional messages related to offers will still be sent to you.

4. Message Frequency and Content

Transactional (Informational) Messages:

You will receive one (1) initial SMS confirming your offer details and up to three (3) reminder SMS messages within thirty (30) days to help you redeem your offer.

Example:

Initial Message: “You’ve claimed an offer at Bluegrass Lending. Redeem by {voucher_expires} here: [link].”

Reminder Messages: “Your offer is still available. Don’t miss out—redeem before {voucher_expires}.”

Marketing Messages:

If you opted in for marketing messages, you may receive messages about promotions, new offers, or special updates. Frequency may vary based on Bluegrass Lending's promotional campaigns.

Example:

“Exclusive offer: 20% off your next visit! Reply STOP to opt-out.”

5. Costs and Fees

Message and data rates may apply. Please check with your mobile carrier for details about your pricing plan and the charges for sending and receiving text messages. You are solely responsible for any costs related to or associated with your receipt of text messages, as set forth more fully in these Terms.

6. Supported Carriers

Our Service is available to major mobile carriers, including AT&T, Verizon, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Boost Mobile, and Virgin Mobile. However, please note that not all mobile devices or handsets may be supported, and messages may not be deliverable in all areas. Bluegrass Lending, its service providers, and mobile carriers are not liable for undelivered messages.

7. Privacy

Your phone number and related data will be handled in accordance with Bluegrass Lending's Privacy Policy, available at bluegrasslending.com.

We do not share your information with third parties except as required for service delivery or legal compliance. For full details on how your data is handled, please refer to Bluegrass Lending's Privacy Policy.

8. Dispute Resolution and Arbitration

Any dispute arising out of or related to these Terms or Bluegrass Lending's SMS communications shall be resolved through binding individual arbitration, not in court. You waive your right to participate in a class action lawsuit.
